Terms of Use

The conditions on which our spaces may be used. Please read them before you book.

Article 1 (Scope)

These terms set out the conditions for using ALBE (“the spaces”), operated by First Create Inc. (“we”, “us”). Customers using the spaces (“you”, “the user”) book on the basis of agreeing to these terms.

Where an individual space has its own rules, what is written on that space's page takes precedence.

Article 2 (When a booking is made)

  1. A booking is made when you apply by the method we specify and payment is completed.
  2. Where you apply by bank transfer and we cannot confirm payment within one week of your application, we may cancel the booking at our discretion.
  3. If we judge that your intended use is contrary to these terms, we may refuse the booking even after it has been made.

Article 3 (Booked time)

  1. Booked time includes preparation, setting up, taking down, and bringing things in and out.
  2. For as long as your belongings, fittings or exhibits remain in the space, the space is treated as in use.
  3. The opening hours given for each space are the hours during which the building can be entered and left. They do not mark the boundaries of booked time.
  4. Where use runs across more than one day, an occupancy charge applies according to the opening hours.

Article 4 (Rates and payment)

  1. The rate is the amount shown on each space's page, inclusive of tax.
  2. The rate does not vary with the number of people or the nature of your use.
  3. Payment is by credit card, bank transfer or another method we specify. We do not accept cash on the day.
  4. Charges for optional equipment and other extras may apply.

Article 5 (Accounts and points)

  1. Opening an account is free. You may open one by the method we specify.
  2. We award points to account holders in proportion to the amount spent. The rate is 1%, which we may change on prior notice. Bookings made without an account neither earn nor may spend points.
  3. Points are awarded on or after the day following use, for bookings that are confirmed and paid for.
  4. One point counts as one yen towards a later booking. Coupons, ticket books and points cannot be combined; only one may be used.
  5. Points are valid for one year from the last day you used a space or earned points. Any use or award within that period extends validity to one year from that day. If a full year passes with neither, the points held lapse. We send a notice to the email address on your account approximately 30 days before expiry. Your points and their expiry can be checked on your account page.
  6. Where a booking is cancelled, no points are awarded for it. If they have already been awarded, they are withdrawn.
  7. Where a booking is cancelled, points applied to it are returned to the account holder. The date of return is treated as the day points were earned for the purposes of paragraph 5 of this Article.
  8. Points cannot be exchanged for cash or refunded, transferred to a third party, or pooled with another account.
  9. Closing your account causes any points held to lapse.
  10. Where we judge that points have been obtained by improper means, we may void them.
  11. We may change the scheme, the award rate and the validity period, or end the scheme, on prior notice.

Article 6 (Changes and cancellations)

  1. Moving a booking to another date or time is free of charge, subject to availability. A change is settled by your request together with our confirmation.
  2. Extending a booking is accepted so far as availability allows. Shortening one is treated as a cancellation of the part dropped, and our cancellation charges apply to it.
  3. Cancellation charges are calculated from the date originally booked: 31 days or more before, free; 30 to 15 days before, 50%; 14 days to the day before, 80%; on the day, 100%. The rates are the same at every space.
  4. Where a booking is cancelled after being moved, the charge is still calculated from the date originally booked.
  5. There are limits on what can be done in the booking system. These are set out on the Changes and cancellations page.
  6. Consecutive or multi-day use, regular use and long-term exclusive use are governed individually by the quotation or written arrangement.
  7. We do not accept changes by telephone or by replying to an email.

Article 7 (What is not allowed)

In using the spaces, you must not:

  1. act contrary to law, public order or good morals;
  2. cause a nuisance to other users, to neighbours, or to other tenants of the same building;
  3. use an open flame or cook without our permission;
  4. attach, fix or alter anything on walls, floors or other fittings without our permission;
  5. bring in pets or other animals (except where two conditions are met: they are not allowed to roam free in the space, and mess is dealt with thoroughly, including taking it away with you);
  6. smoke inside the building;
  7. occupy anywhere other than the space booked, such as corridors, stairs or common areas;
  8. create strong odours;
  9. shoot adult content, or use the space in any way involving excessive nudity;
  10. do anything prohibited by the individual rules of the space;
  11. do anything else we judge to be inappropriate.

Article 8 (Declaring your intended use)

  1. We may require you to declare your intended use when you apply.
  2. Where a declaration proves false, we may require use to stop and you to leave. No refund is made in that case.

Article 9 (Putting things back and cleaning)

  1. You must restore the space to its original condition by the end of your booking.
  2. Rubbish must be taken away with you. Where we dispose of it, a separate charge applies.
  3. Where the space is not restored, we may take the necessary steps at your expense.

Article 10 (Damages)

Where you damage the fittings, equipment or building, you are liable to compensate for that damage.

Article 11 (Limits of liability)

  1. We are not liable for accidents, theft or loss occurring within the spaces, except where caused by reasons attributable to us.
  2. Where we cannot provide a space because of a natural disaster, power failure, equipment breakdown or other unavoidable cause, we refund the fee and bear no liability beyond that.
  3. We may keep items left behind for a certain period and then dispose of them.

Article 12 (Exclusion of organised crime groups)

You represent and warrant that you are not a member of an organised crime group or any similar antisocial force. Should this prove otherwise, we may refuse use immediately or terminate the booking.

Article 13 (Personal information)

We handle your personal information in accordance with our Privacy policy (JP).

Article 14 (Changes to these terms)

We may change these terms where we judge it necessary. The revised terms take effect when posted on this page.

Article 15 (Governing law and jurisdiction)

These terms are governed by the law of Japan. Any dispute concerning use of the spaces shall be subject to the exclusive jurisdiction of the Nagoya District Court in the first instance.
